Acceptable Use Policy

This Acceptable Use Policy (“AUP”) forms part of the Terms and Conditions governing your use of the Avatarmy platform, tools, and related services provided by AVATARMY OÜ (“Avatarmy”, “we”, “us”).

It describes the conduct we expect from all users and the activities that are strictly prohibited to ensure lawful, fair, and safe use of the platform.

By accessing or using any part of the Avatarmy platform, you agree to comply with this AUP. Violation of this policy may result in suspension or termination of your account or access to the platform.

Purpose and scope 

This AUP applies to all uses of the Avatarmy platform, including but not limited to:

  • The Avatarmy web interface and AI-assisted services (LUCA, NOVA, LEXIS, ARIA, BRAVO, etc.);
  • APIs, integrations, messaging channels (e.g., WhatsApp, email connectors), and associated dashboards;
  • Any data processed, transmitted, or stored through Avatarmy’s systems.

Avatarmy acts solely as a technical service provider and data processor, executing the documented instructions of the user (controller). You remain responsible for ensuring that your instructions and activities comply with all applicable laws and this AUP.

Lawful and responsible use  

You must use the Avatarmy platform only for lawful, authorized, and legitimate business purposes consistent with your role as a Controller under applicable law.

You agree that your use will at all times comply with:

  • Applicable data protection laws (including GDPR, CCPA/CPRA, and local equivalents);
  • The Terms and Conditions, Data Processing Agreement (DPA), and other legal policies referenced therein;
  • Platform-specific limitations set by Avatarmy (such as lead caps, processing scope, and instruction boundaries).
Prohibited activities  

You are strictly prohibited from using the platform or its content for any of the following purposes or in any of the following ways:

  1. Unlawful or Unauthorized Activities
    • Engaging in or facilitating any illegal activity, including fraud, identity theft, or data misuse.
    • Using the platform in violation of any international, federal, state, or local laws, including data protection, anti-spam, or intellectual property laws.
    • Instructing Avatarmy to collect or process personal data without a lawful basis or beyond the scope of your legitimate business purpose.
    • Circumventing or violating the terms of service of third-party platforms or data sources (e.g., scraping login-protected or restricted content contrary to external site policies).
  2. Misuse of Platform or Systems
    • Attempting to bypass, disable, or interfere with security or access control mechanisms.
    • Uploading, transmitting, or distributing malicious code, including viruses, worms, Trojan horses, or bots.
    • Reverse-engineering, decompiling, or attempting to extract source code or internal algorithms of Avatarmy’s AI systems.
    • Performing automated actions (bots, scripts, crawlers) outside of Avatarmy’s approved system operations.
    • Overloading or disrupting Avatarmy’s infrastructure or those of its subprocessors (e.g., WhatsApp Business API, AWS).
  3. Misuse of AI and Communication Tools, using AI avatars (LUCA, NOVA, ARIA, BRAVO, or others) to:
    • Send unsolicited marketing or spam messages.
    • Misrepresent your identity, services, or affiliation.
    • Engage in profiling or automated decision-making that violates applicable law.
    • Collect, infer, or store personal data of individuals without authorization or notice.
    • Generating or instructing AI avatars to create false, defamatory, discriminatory, or misleading information.
    • Using avatars to harass, intimidate, or manipulate individuals or groups.

      Note: Avatarmy’s avatars must always act within your documented, lawful instructions and only for the business purpose defined in your agreement. Any use outside this context is prohibited and may trigger suspension.
  4. Intellectual Property and Confidentiality Violations
    • Uploading or using materials that infringe any copyright, trademark, or other proprietary rights.
    • Distributing unlicensed creative assets (music, fonts, stock images, etc.) or violating license conditions as defined in internal rules (e.g., IP_Licenses_Music_Fonts).
    • Sharing, exporting, or disclosing confidential information or proprietary data of Avatarmy, other users, or third parties.
  5. Data and Privacy Misconduct
    • While Avatarmy does not independently determine data purposes, you may not:
    • Combine or merge personal data across multiple clients or projects.
    • Reuse data collected for one campaign to benefit another client or purpose.
    • Retain personal data after the completion of processing beyond lawful retention limits.
    • Provide Avatarmy with data from sensitive categories (e.g., medical, political, biometric data) unless explicitly authorized and covered under your DPA.
  6. Misrepresentation and Abuse
    • Impersonating Avatarmy or representing yourself as its employee, partner, or agent.
    • Attempting to access or modify another user’s account or data without authorization.
    • Selling, sublicensing, or reselling access to Avatarmy’s platform or any AI output without written consent.
    • Using the platform for personal gain outside the intended business scope or to develop competing products.
Monitoring and enforcement   

Avatarmy may monitor platform activity for security, compliance, and service integrity purposes.
If Avatarmy determines (in good faith) that you have violated this AUP, we may:

  • Suspend or terminate your access immediately;
  • Restrict specific features or integrations;
  • Report unlawful activity to authorities or affected Controllers;
  • Seek legal remedies as permitted by law.
Reporting violations    

If you believe someone is violating this AUP or misusing Avatarmy’s systems, please contact our compliance team at EMAIL.

Provide as much detail as possible (URLs, timestamps, examples) so that we can investigate appropriately.

Updates to this policy   

Avatarmy may modify this AUP periodically to reflect evolving legal, security, and platform requirements. The most recent version will be available at our website, with the “last modified” date displayed above. Material changes will be communicated to registered users where required by law or contract.
